Terms and Conditions
General
Terms
1.Introduction
1.1 These
Conditions apply to all guests at and visitors to Blyton
Ponds (BP)
2.
Bookings
2.1
Guests may book in advance or on arrival. Rooms are
subject to availability and BP reserves the right
to
refuse
any booking for good reason.
2.2
Although full payment is required on departure, guests
will be required to provide a deposit by credit card on
booking via the internet through our website or a cleared
postal payment before arrival.
3.
Check-in and Check-out Times
3.1
Guests may check-in at any time from 1.00 p.m. on day of
arrival.
If a
guest has not checked-in by 4.00 p.m., BP is entitled to
re-let the room unless the guest has notified BP that
he/she will be arriving late. Accommodation booked on
pre-paid rates will be held for the entire day of
arrival.
3.2 On
departure, guests must vacate their rooms and check-out
by no later than 10.00a.m. Failure to do so will entitle
BP to charge for an additional term of stay.
4.
Charges
4.1
Charges will be at the current published BP room rates as
displayed in all accommodation units, the company web
site and available on request. Price lists for additional
items, such as Cafe meals and Fishing tickets, are on
display at relevant locations and available on
request.
5.
Payment
5.1
Guests must pay all outstanding charges on
departure.
6.
Cancellation
6.1 The
cancellation policy varies according to the rate that is
booked. Please refer to the individual Full
Rate
Descriptions
upon booking.
7.
Relocation
7.1 In
the unlikely event that BP does not, for any reason have
the required number and types of accommodation available
as per the Booking, BP reserves the right to relocate the
Client to alternative accommodation of a similar standard
in the near locality. The extra and reasonable
accommodation expenses incurred for equivalent
accommodation (for the first night only) shall be at BP's
discretion, which will normally be exercised in favour of
the Client and be borne by BP.
The
acceptance of this obligation (which will not release the
Client of the obligation to pay BP the relevant Charges)
shall be in lieu of all other liabilities or obligations,
which are hereby expressly excluded.
8.
Right of Refusal
8.1
Blyton Ponds reserves the right to refuse a guest entry
and accommodation if, on arrival, management reasonably
considers that the guest is under the influence of drink
or drugs, is unsuitably dressed or is behaving in a
threatening, abusive or otherwise unacceptable manner.
Such refusal will result in the forfeit of all deposits
paid.
9.
Disturbance
9.1
Blyton Ponds reserves the right to require a guest to
leave if he/she is causing a disturbance, annoying other
guests or BP staff or is behaving in an unacceptable
manner. Such action will result in the forfeit of all
deposits and payments made with no refunds.
10.
Complex Rules
10.1
Guests shall comply with all reasonable rules and
procedures in effect at Blyton Ponds, including but not
limited to health and safety and security procedures and
statutory requirements as to registration.
10.2
Guests shall agree not to accommodate or offer to
accommodate any persons other than the authorised persons
registered at check-in
10.3
Guests are allowed guide dogs only but no other animals
or pets are allowed on the Blyton Ponds site.
10.4
Children under the age of 14 are not allowed on the
Blyton Ponds site without express permission with such
permission provided at the time of booking.
11.
Valuables
11.1
Guests with valuables should ensure the safety and
security of such valuables at all times.
11.2
Blyton Ponds will not be liable for any loss or damage to
any valuables brought on site by guests and
visitors.
12.
Losses, Liabilities, Responsibilities etc.
12.1 In
the event of any loss of personable valuables, guests
should report any loss of or damage to their property
immediately and shall make themselves available to assist
with any reports made by Blyton Ponds staff to the local
police authorities.
12.2
Guests shall not enter areas of the Blyton Ponds site
which are indicated as being closed to the public. Blyton
Ponds shall not be responsible for death, personal injury
or loss or damage to property suffered by a guest in such
areas.
12.3
Blyton Ponds shall not be liable to a guest for any loss
or damage to property caused by the misconduct
or
negligence
of a guest or an Act of God, or where the guest remains
in exclusive charge of the property concerned.
12.4
Blyton Ponds liability for any other loss of or damage to
a guest's property is limited to £50 for any one
article or £100 for multiple articles where they may
be lost or damaged through the default, neglect or wilful
act of the Blyton Ponds company or members of
staff.
12.5
Blyton Ponds shall not be liable for any failure or delay
in performing any of its obligations under this Agreement
if the failure or delay was due to any cause beyond its
reasonable control, including (without limitation) war or
threat of war, civil or political action or disturbance,
riot, natural disaster, fi re, epidemic, bad weather,
terrorist activity (threatened or actual), military
activity, governmental or regulatory action, industrial
dispute, act of God, failure of power or machinery,
failure of or interruption in externally provided
services and utilities, and all similar events outside of
BP's control.
12.6
Whilst all reasonable efforts have been taken by the BP
to ensure that Bookings made under this Agreement are
able to proceed, BP reserves the right to relocate any
Booking to another property of similar size and standard
in the locality. The Client acknowledges that BP accepts
no liability for any loss or damage suffered by or caused
to the Client in consequence of the relocation of the
Client.
12.7 For
the avoidance of doubt, BP does not exclude its insured
liability for death or personal injury caused by
BP's
negligence and all suitable and applicable insurance
policies in respect of third party liabilities are
available for inspection if required
12.8
Guests should also refer to the Notice relating to Loss
or Damage to Guest's Property displayed in all
accommodation units.
12.9
Blyton Ponds is not liable for any loss or damage caused
to a guest's vehicle, unless proven to be caused by the
wilful misconduct of Blyton Ponds or BP staff. Two car
parks are available to guests and visitors with a maximum
capacity of 15 vehicles each. Individuals attempting to
exceed parking limitations and restrictions do so at
their own risk.
12.10 All
guests and visitors are obliged to read and comply with
the published fire regulations in force at Blyton Ponds
and ensure they are fully aware of site procedures in
case of fire and the location of the fire assembly point.
Any guests in doubt relating to such regulations should
ask at reception for a copy of the site fire regulations
and procedures.
12.11
Site safety is the responsibility of all individuals on
site and in the event of any accident concerning
individuals falling into a pond, suitable flotation
devices are available at each pond location. It is the
responsibility of all individuals on site to make
themselves aware of the location of all such safety
devices.
12.12
Guests will be liable for any loss, damage or personal
injury they may cause at Blyton Ponds..
12.13
These Conditions shall be governed by English law and in
the case of any dispute, all parties to such a dispute
agree to submit to the jurisdiction of the English
courts.
